What do I need? What’s the process?

Building waterfront access or erosion intervention on Cape Cod involves navigating several regulatory requirements to ensure compliance with state and local laws. We are here to chart the course of making it a reality through our knowledge of the Cape’s unique shorelines and the many rivers, lakes, and ponds.

Step 1
Engage an Engineer & Beacon Marine

Your first step should include engaging both an engineer and Beacon Marine. The engineer will design your project and permit the project. Beacon Marine can make sure you are working with a qualified engineer who is best suited for the type and location of your project. Beacon Marine will work closely with the engineer to make sure the project is optimized for cost and feasibility. We’ve built strong relationships with leading engineering firms in the region and are happy to connect you, so your project is represented well from the start and set up for a smooth permitting and construction process.

Step 2
Permitting

The permitting process is a necessary step in any structure. Sidestepping the permitting process can result in fines, fees, and mandatory removal of an unpermitted structure. Any project proposed to our company must be properly permitted.

The Engineer will submit a Notice of Intent (NOI) to the local conservation commission. The NOI includes project plans, environmental impact assessment and proof of notification to municipal authorities.

The Commonwealth of Massachusetts may require a Chapter 91 Application. This statute  governs structures and fills in tidelands, great ponds, and navigable rivers. If your proposed project involves construction, placement, or alteration of structures in these areas, you will need a Chapter 91 license from the Massachusetts Department of Environmental Protection (MassDEP).  This may involve submitting project details, environmental impact analyses, and coordinating with other state agencies.

The Conservation Commission will review and assess the environmental impact of your proposed dock and may issue an Order of Condition outlining permissible activities and mitigation measures.

MassDEP will evaluate your Chapter 91 application to ensure compliance with state regulations protecting public trust lands and waterways.

Depending on your project’s specifics, reviews from agencies such as the Massachusetts Division of Marine Fisheries or the Natural Heritage & Endangered Species Program may be required. An example of this is a shellfish study to determine the species in the habitat surrounding the proposed project area.

For seasonal or floating docks, an annual permit for the town Harbormaster may be required. This type of permit is common for temporary structures like bottom-anchored floats or rafts.

Step 3
Request for Proposal

Once the permitting is approved, providing the engineering plans, Order of Conditions, and  a copy of the Chapter 91 license to Beacon Marine for Chris Hagerty, Partner & Construction Manager, to review.  

Once the documents are received, Chris will call and discuss the project and arrange a date and time for an on-site visit. At the end of the meeting, you’ll have the timeline when the detailed quote will be ready for your consideration. This quote will include the labor, equipment, and building material specific to the project. These materials will adhere to guidelines set forth in the Orders of Conditions regarding construction materials and design specifications to minimize environmental impact.

Step 4
Choosing Beacon Marine

You’ve accepted the proposal. We will need a signed contract and a deposit to schedule the project. The project will not be scheduled until the deposit is received.

Step 5
Construction is Underway

Our Construction team will be in consistent communication with you from the pre-construction/staging phase to the build out phases and seeing it through to the final inspection. We will coordinate with subcontractors like electricians, plumbers, and landscapers to make sure all the details are in place. Another payment will be expected as outlined in the contract.

Step 6
Post Construction

The final payment for the construction is expected at the time of completion.

This is also the time to coordinate seasonal service. Our Services & Maintenance department can schedule the removal and storage of seasonal docks, floats, gangways, and stairs. You can also request an ice prevention system to protect your dock in freezing temperatures.
